Acceptance of Terms

By downloading, installing, or using Tomato (the "App"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you may not use the App.

Grant of License

We grant you a limited, non-exclusive, revocable, personal license to use the App on devices you own, solely for your personal productivity and time management.

Restrictions

You agree not to:

• Reverse engineer, decompile, or attempt to derive the source code
• Rent, lease, lend, sell, or transfer the App
• Modify or create derivative works
• Use the App for commercial purposes without authorization
• Attempt to gain unauthorized access to servers or data
• Remove or obscure any copyright, trademark, or proprietary notices

User-Generated Content

Sessions, tasks, and settings you create in the App ("Your Content"):

• Remain your property at all times
• Are stored on your device and private iCloud account
• May be exported via the CSV feature
• Are deleted permanently when you delete them

We have no claim to Your Content and do not archive or monitor it.

Disclaimer of Warranties

We do not warrant that:

• The App will be error-free or uninterrupted
• Any defects will be corrected
• The App will meet your expectations

Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Loss of data, revenue, or profits
• Indirect, consequential, or incidental damages
• Claims arising from use of the App
• Timer inaccuracies or missed notifications
• Loss of synced data due to network issues

This limitation applies even if we've been advised of the possibility of such damages.

Data Loss Acknowledgment

You acknowledge that:

• Device-local storage can be lost if the app is deleted or device is reset
• CloudKit sync depends on stable internet and iCloud account status
• We maintain no separate backups of your data
• You are responsible for creating exports if you need permanent records

Third-Party Services

This App uses Apple's services (CloudKit, App Store):

• Governed by Apple's Terms of Service
• We are not responsible for Apple's services or policies

Modification of Terms

We may update these Terms of Use at any time. Your continued use after changes constitutes acceptance of the updated terms.

Termination

We may terminate or suspend your access if you violate these terms. Upon termination, your right to use the App ceases immediately, though your locally-stored data remains yours.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force.
